Filing a Wrongful Death Lawsuit

Tragically, some cases of medical malpractice result in the death of the patient. In these circumstances, close family members of the victim have the right to file a wrongful death lawsuit.

Immediate family members such as spouses, life partners, children, adopted children, and any other dependents have priority in wrongful death suits. If no immediate family members or financial dependents exist, extended family such as parents, adult children, and other dependents may be eligible to file suit.

Utah state law requires eligible family members to file suit within two years of the date of death.

Medical Malpractice Laws in Utah

The state has established specific laws relating to cases involving medical negligence and malpractice:

  • Time Limitations

    State Code: 78B-3-404  A claim for medical malpractice has to be within two years of the date of the injury or the discovery of the injury; but, all claims must be filed within four years of the injury.

  • Caps On Certain Damages

    State Code: 78B-3-410  State law places limits on the award of non-economic damages in malpractice actions. In all cases arising on or after May 15, 2010, the cap on non-economic damages is $450,000.

  • Emergency Room Protections

    State Code: 58-13-2.5  Emergency rooms have special protections, which raised the standard of evidence. Lawyers have to present a case with “clear and convincing” evidence as opposed to the "preponderance of evidence" that was previously required in these cases.
