After his passing, the man’s grieving family came to our law firm. Our attorneys determined that the clinic repeatedly overlooked clear signs of serious cardiac problems, specifically symptoms of aortic dissection. They misdiagnosed the man as suffering from abdominal pain and constipation instead of sending him to the emergency room. 

Despite their egregious and lethal failure, the defense rejected our $1 million settlement offer. Our attorneys took the case to court. Over an 8-day civil trial, we successfully persuaded the jury that the negligent medical clinic was at fault for the man’s passing. This resulted in a $2.9 million jury verdict for his family. 

Victims Can Be Compensated Even If They Were Partially At Fault

In the case described above, the jury decided that the deceased was 30% responsible for his death because he could have gone to the emergency room on his own volition. Despite this determination, his family was able to receive the compensation they deserved. This was possible because Utah is a modified comparative negligence state. 

Modified comparative negligence means that the victim’s behavior did not need to be perfect for damages to be received. In fact, the victim can be accountable for a significant portion of their harm and still receive compensation. The key factor that must be proven is whether or not the defendant was more responsible for the suffering caused than the victim. 

Proving proportionate responsibility is complex. In many cases, juries are overly sympathetic to the difficult task of being a doctor.
