Medical Misdiagnosis Is Tragically Common

As reported by Healthline, 12 million Americans receive a medical misdiagnosis each year. This staggering statistic shows that misdiagnosis is far too common.

If you have even a sneaking suspicion that you or your loved one has suffered due to medical misdiagnosis, you should speak to our attorneys. We can assess the viability of your potential case at absolutely no cost to you.

Legal Elements Our Lawyers Focus On

In a misdiagnosis claim, there are four legal elements that our Utah lawyers will focus on proving in court to tackle your medical malpractice case.
In a misdiagnosis claim, there are four legal elements that our Utah lawyers will focus on proving in court to tackle your medical malpractice case.

A Professional Duty Owed to the Patient

Our lawyers work to prove that an established professional relationship between you and your physician required them to provide care to you.

Breach of Such Duty

To prove breach of duty, our lawyers look into how another physician may have easily met the care you required. For instance, if you suffered a personal injury to your left leg but the physician operated on your right leg, they did not uphold a standard of care.

Injury Caused by the Breach

Next, our lawyers will work to prove that the negligence on the part of your doctor resulted in further personal injury. For instance, if your illness was improperly diagnosed or not diagnosed at all and spreads to a later stage that requires more medical intervention, we may argue that the standard of care resulted in further injury.

Resulting Damages

Lastly, our lawyers calculate the total cost of your damages from your doctor's negligence (both economic and non-economic) and work to fight for your fair compensation.

Our law firm has a track record of success in the field of medical malpractice. We have developed a strong network of medical experts from all over the country who we can call to review a misdiagnosis. Our medical consultants teach at universities and hospitals nationwide, routinely publish medical papers, and can provide us with the necessary tools to definitively establish liability in your case.

What Can Be Misdiagnosed?

Misdiagnosis can occur for a variety of conditions, illnesses, and injuries. The following are prominent examples; however, it should be noted that misdiagnosis is by no means limited to the categories below. Our attorneys can represent clients in a variety of misdiagnosis cases.

Time is of the essence when it comes to diagnosing cancer. Medical malpractice involving cancer diagnoses often occurs when the symptoms are attributed to another (often benign) disease. Our Salt Lake City lawyers represent clients affected by misdiagnosis of or failure to diagnose cancer.

Heart Attacks

There are many cases in which patients go to the ER complaining of chest pain, but leave after being treated for gastrointestinal problems (if they’re treated at all). There are similarities between the symptoms of intestinal issues and heart attacks, and a misdiagnosis can prove deadly.

Bone Fractures

Broken bones that are not set, or set incorrectly, can cause debilitating pain and disability, requiring extensive treatment down the road. Our personal injury and medical malpractice lawyers have the expertise necessary to build a compelling and factual case on your behalf, helping you to secure the compensation you deserve.

A Misdiagnosis Can Lead to Tragedy

A misdiagnosis can make your medical condition life-threatening due to:

If you or your loved one has been misdiagnosed, they are most likely not receiving the treatment that will heal their condition. This can lead to worse symptoms, surgery, and more serious physical health issues.

Delayed Treatment

A misdiagnosis can result in the correct treatment being delayed. In many medical cases, the timing of receiving treatment is crucial because the condition may eventually become terminal if not treated in time.

No Treatment

A misdiagnosis can lead to your doctor prescribing no treatment at all. This can result in worse symptoms and can cause the patient to be sick for a prolonged period or eventually lose their life.

We Achieve Many Major Verdicts & Settlements

Our attorneys have won millions upon millions of dollars for Utah’s victims of medical malpractice. Our seven-figure victories have come in the form of arbitration awards, settlements, and when necessary, jury verdicts.

Our Noteworthy Wins Include Misdiagnosis Cases

Knowing you are retaining attorneys who have proven their ability to win misdiagnosis cases can provide true peace of mind.

One of our notable misdiagnose cases was won on behalf of the family of a Utah Transit Authority employee who passed away after two separate misdiagnoses at the same medical clinic.

After his passing, the man’s grieving family came to our law firm. Our attorneys determined that the clinic repeatedly overlooked clear signs of serious cardiac problems, specifically symptoms of aortic dissection. They misdiagnosed the man as suffering from abdominal pain and constipation instead of sending him to the emergency room.

Despite their egregious and lethal failure, the defense rejected our $1 million settlement offer. Our attorneys took the case to court. Over an 8-day civil trial, we successfully persuaded the jury that the negligent medical clinic was at fault for the man’s passing. This resulted in a $2.9 million jury verdict for his family.

Victims Can Be Compensated Even If They Were Partially At Fault

In the case described above, the jury decided that the deceased was 30% responsible for his death because he could have gone to the emergency room on his own volition. Despite this determination, his family was able to receive the compensation they deserved. This was possible because Utah is a modified comparative negligence state.

Modified comparative negligence means that the victim’s behavior did not need to be perfect for damages to be received. In fact, the victim can be accountable for a significant portion of their harm and still receive compensation. The key factor that must be proven is whether or not the defendant was more responsible for the suffering caused than the victim.

Proving proportionate responsibility is complex. In many cases, juries are overly sympathetic to the difficult task of being a doctor. The complexity of misdiagnosis cases makes it all the more important to retain lawyers like ours with deep medical knowledge. Call or write to us to discuss your potential case.

I recommend this firm to anyone who needs attorneys who will fight for your case like it’s their own family.

Younker Hyde Macfarlane, I can't say enough good things about this firm... They kept us informed on every little thing they did and every decision that was made. This law firm was not about the money they were going to make off of us, but the concern they had for the death of our mother. Younker Hyde Macfarlane, they got justice for my mom, some healing for us knowing that the negligence was not going to go unnoticed, monetary or otherwise. Thanks again for all you did for us.
